The terms and conditions that apply when you access and use the PayClaim platform and claim services.

1. Acceptance of Terms

By accessing or using PayClaim (payclaim.com.au), operated by Ken Zhao ABN 27 624 169 069 (“PayClaim”, “we”, “us”, “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the service.

2. Service Description

PayClaim is an online platform that assists subcontractors in preparing and serving payment claim documentation under the Building and Construction Industry Security of Payment Act 1999 (NSW) and equivalent legislation in other Australian states and territories (“the Act”). PayClaim automates document preparation and delivery — it does not provide legal advice and is not a law firm.

3. Eligibility

You must be at least 18 years old and be using the service in connection with a genuine construction or subcontracting business operating in Australia. By registering, you represent and warrant that this is the case.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@payclaim.com.au if you suspect unauthorised access.

5. Fees and Payment

  • Claims are charged at $79 per claim (inclusive of GST where applicable).
  • Referral credits ($10 per qualifying referral) are applied to your account balance and may be used to offset future claim fees. Credits have no cash value and are non-transferable.
  • Payment is processed via Stripe. By submitting payment you agree to Stripe’s terms of service.
  • All fees are in Australian Dollars (AUD).

6. Refund Policy

Once a payment claim document has been generated and the service delivery process has commenced, fees are non-refundable. If a technical error on our part prevents successful delivery, we will re-attempt delivery at no additional charge or issue a credit at our discretion. Contact support@payclaim.com.au within 7 days of the transaction if you believe you are entitled to a remedy.

7. Use of the Service

You agree to:

  • Provide accurate and complete information when preparing a claim;
  • Use the service only for lawful purposes and in accordance with the Act;
  • Not use the service to make false, misleading, or vexatious claims;
  • Not attempt to reverse-engineer, scrape, or exploit the platform.

8. Disclaimer — Not Legal Advice

PayClaim generates documents based on information you provide. Nothing on this platform constitutes legal advice. The accuracy and completeness of your claim is your responsibility. We strongly recommend you seek independent legal advice if you are uncertain about any aspect of your payment claim or the applicable legislation. PayClaim is not liable for any outcome arising from use of documents generated by the platform.

9. Intellectual Property

All content, software, and trade marks on this platform are owned by or licensed to PayClaim. You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose. You may not reproduce or redistribute any part of the platform without our written consent.

10. Limitation of Liability

To the maximum extent permitted by Australian law, PayClaim’s total liability to you for any claim arising out of or in connection with these Terms or the service (whether in contract, tort, or otherwise) is limited to the fees you paid for the specific claim to which the liability relates. We are not liable for any indirect, consequential, special, or incidental loss.

Nothing in these Terms excludes any guarantee, warranty, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

11. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms.

12. Referral Program

The referral program is offered at our discretion and may be modified or discontinued at any time. Credits are awarded only when a referred user completes a first paid claim. Referrals must be genuine — fraudulent referral activity will result in account suspension and forfeiture of credits.

13. Termination

We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or for any other reason at our discretion. You may close your account at any time by contacting support@payclaim.com.au.

14. Changes to Terms

We may update these Terms from time to time. We will notify you by posting the updated Terms on this page with a revised effective date. Continued use of the service after changes take effect constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
